1. General

This privacy policy describes the policy of AllGood (“AllGood, “us”, we” “our”, as context may dictate) regarding the collection, use, storage, sharing and protection of your personal information ("Privacy Policy"). This Privacy Policy applies to the www.allgood.market website ("AllGood" or "Website") and all related websites, applications, services and tools where reference is made to this policy ("Services"), regardless of how you access the Services, including access through mobile devices. AllGood Inc. is the data controller.

Scope and consent: By using AllGood and related Services, you give explicit consent to AllGood for the collection, use, disclosure and retention of your personal information by us, as described in this Privacy Policy and our Terms of Service.  We will only use your personal information in accordance with this Privacy Policy and our Terms of Service unless otherwise required by applicable law.

AllGood may change this Privacy Policy from time to time. We advise you to read it regularly. Substantial changes to our Privacy Policy will be announced on our Website. The amended Privacy Policy will be effective immediately after it is first posted on our Website. This Privacy Policy is effective as of June 2021.

2. What personal information do we collect

You can visit our Website without registering for an account. When you decide to provide us with your personal information, you agree that such information is sent to and stored on our servers. We collect the following types of personal information:

  1. Information we collect automatically: When you visit our Website, use our Services and or reply to ads or other content, we automatically collect the information sent to us by your computer, mobile device or other equipment that provides access. This information includes, but is not limited to:
  • information from your interaction with our Website and Services, including, but not limited to, device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from www.allgood.market referring URL, ad data, IP address and standard web log information; and
  • information we collect through cookies, web beacons and similar technologies. 

  • Information you provide to us: We collect and store any information you enter on our Website or that you provide to us when you use our Services. We collect data that is necessary for us to provide Service to our Users. This information includes, but is not limited to:
  • For Buyers or Donors/Sellers: information that you provide to us when you register for an account or for the Services that you use such as: your name; user ID; e-mail address; mobile number; your credit card and payment details; your geographic area; profile picture; Facebook or Google account details; and any other information you choose to provide in connection with your account and additional information that you may provide to us through social media sites or third party Services;
  • For Charities or Campaigns: at the time of signing up on our Webiste we collect the following information: Name of the charity, non-profit organization or campaign; website address; head office address; name of the applicant; applicants position; applicant’s address; applicant’s phone number; applicant’s email address; campaign goals/description and any other information you choose to provide in connection with your account. Please note that the above information will be collected at the time of signing up on our Website. Once your Charity/Campaign signs up on our Website, we may invite you to sign our Partner Agreement in order to register your Charity/Campaign with us. At that time, we may collect additional information about you and your Charity or Campaign (For more information, please refer to our Partner Agreement once made available for your consideration).
  • information provided in the context of dispute resolution, correspondence through our Website or correspondence that is sent to us; 
  • information about your location and the location of your device, including your device’s unique identifier information if you have enabled this service on your mobile device;

  1. Information from other sources: We may receive or collect additional information about you from third parties and add this to our account information. This information includes, but is not limited to: demographic data, navigation data, additional contact data and additional data about you from other sources, such as public authorities, to the extent permitted by law. 

3. How we use your personal information

You agree that we may use your personal information for the following purposes:

  • to provide you access to our Services and Customer Support by means of e-mail or telephone; 
  • Ensure that you are properly registered to use our services and to receive any associated technical support
  • Process and collect payments/donations;
  • to prevent, detect and investigate potentially prohibited or illegal activities, fraud and security breaches and to enforce our Terms of Service; 
  • to personalize, measure and improve our Services, content and ads; 
  • to contact you, by e-mail, push notification, text message (SMS) or by telephone, to inquire about our Services for the purpose of targeted marketing activities, updates, and promotional offers based on your message preferences (where applicable), or for any other purposes as set forth in this Privacy Policy; 
  • to analyze data usage trends and preferences in order to improve the accuracy, effectiveness, security, usability of our Services;
  • to learn how users interact with our Services in order to personalize the content of our Services, such as customizing the language and campaigns on our Website based on your location;
  • Inform you of any important services revisions and updates;
  • for administrative and customer service purposes (e.g., to provide services and information that you request or to respond to comments and questions) and
  • to provide you with other services that you have requested, as described when we collected the information.

Aggregate data: Aggregate data is general information about groups of customers and does not identify individual customers. AllGood may combine your information with that of other customer to generate aggregate data that can be used to improve our service or develop new ones. For example, we may tell a third party how many users have subscribed to a particular service, but not identify that you personally are a subscriber.  

Notwithstanding any provision herein, AllGood may share information from or about you with subsidiaries, joint ventures, or other companies under common control, in which case AllGood will require them to honor this Privacy Policy.

Sharing information with and registration on social media sites: We may offer sign-on Services that enable you to access the Website or related websites with your login credentials. We can also offer Services that enable you to share information with third party social media websites, such as Facebook, Google Plus and Twitter.

If you provide us access to personal information stored on third party websites, the scope of access to this personal information shall vary per website and will be determined by both your own browser settings and your consent. If you wish to connect your third party account to your AllGood account and you consent to us accessing the information in these third party accounts, you agree that we can collect, use and store information from this third party website in accordance with this Privacy Policy.

Transfer of your personal information to third parties: We may disclose your personal information to third parties in accordance with this Privacy Policy and applicable legislation and regulations. As further described under Section 4, we will not disclose your personal information to third parties for their marketing purposes without your explicit consent. We may share your personal information with:

  • AllGood Inc.  to provide content and services (such as registration and customer support), to prevent, detect and investigate possible illegal activities, violations of our policy, fraud and/or data security breaches, and to support decision making on products, websites, applications, services, tools and communication.
  • service providers with whom we have entered into an agreement to help us provide our Services on the website, such as financial service providers, marketing agencies and technical support. In such cases, the personal information shall remain under the control of AllGood.
  • payment processors:  By submitting your debit or credit card Information through the Services, you expressly consent to the sharing of your information with third-party payment processors and other similar third-party service providers.
  • corporate affiliates: We may share your data with other AllGood group companies which are located within as well as outside of Canada.
  • certain third parties (such as intellectual property rights holders, supervisory authorities, tax authorities, police and other regulatory authorities) if we are required to do so by law, or in accordance with our Privacy Policy. We may share your personal information with these authorities for the following purposes:

- to comply with legal obligations or a court order; or

- if this is necessary for the prevention, detection or prosecution of criminal    offenses, such as fraud, deceit or prosecution, or

- if it is necessary to maintain our policies or to protect the rights and freedoms of others.

  • other third parties to whom you have given consent to share your information via AllGood, e.g. in the framework of a cooperation, such as participating Charities and/or charitable Campaigns. We share your information with Charity/Campaign Organizers. For example, if you donate to a Charity/Campaign through a sale of an item on our Website, we share your name and your email address with Charity/Campaign Organizer, who may contact you. The Charity/Campaign may contact you for the sole purpose of issuing a tax receipt for your donation. They will contact you only if you chose an option on our Website to receive a tax receipt for your donation. If you opt out and chose not to receive a tax receipt, your information will not be shared with the Charity/Campaign you donated to and they will not contact you.  By using the Services you expressly consent to the sharing of your information with third parties that you have agreed to enter into a transaction with through the Services, to the extent that information reasonably needs to be shared to facilitate such transaction.
  • companies that we intend to merge with in the context of a re-organisation or that acquire us.   In the event that AllGood, or all or a portion of AllGood's business, or one or more of its divisions, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, liquidation or other similar transaction, your personal information shall be one of the transferred assets. If we engage in such a sale or transfer, we will make reasonable efforts to direct the recipient to use your personal data in a manner that is consistent with this privacy policy. After such a sale or transfer, you may contact the recipient with any inquiries concerning the recipient’s privacy practices.  To the extent that AllGood is required to do so by law, you will be notified of any changes in ownership or use of your personal information.
  • an intellectual property owner if the owner of an intellectual property right or an intermediary in good faith believes that an advertisement violates the rights of the owner. Before personal information is provided, the IP owner will enter into an agreement that, inter alia, stipulates that information is only provided on the strict condition that it may only be used in the context of legal proceedings and/or obtaining legal advice and/or to answer questions from the relevant advertiser
  • Publicly available information: When you post an item for sale using our Services, you may choose to make certain personal data visible to other AllGood users. This may include your first name, last name, your email address, your location and your contact number. Please note, any information you provide to other users can always be shared by them with others so please exercise discretion in this respect.

Information you share on www.allgood.market: Our Website allows users to share advertisements and other information with other users, thereby making this shared information accessible to other users. Since our Website also enables you to directly contact a Buyer or Donor/Seller, we recommend that you consider how you share your personal information with others. You are solely responsible for the personal information you share through our Website and therefore we cannot guarantee the privacy or security of the information shared by you with other users.

In case you visit our Website from a shared computer or a computer in an internet café, we strongly recommend that you log off after each session. If you do not want the shared computer to remember you and/or your credentials, you will need to remove cookies and/or the history of your website visits.

Your data controller may transfer data to us as described in this Privacy Policy and we may process and keep your personal information on servers in Canada and our data processing centers in other parts of the world.

4. Marketing Purposes

You agree that we may use the information collected by us to send you offers, whether personalised or not, or to contact you by telephone regarding products or Services offered by AllGood.

We will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our Services and functionalities.

When you no longer wish to receive marketing communications from us, you can, where applicable, change your preferences in your AllGood account, or follow the unsubscribe link in the marketing communication you received.

If you opt out of receiving marketing or commercial communications, we retain the right to send you non-marketing communications such as correspondence about your relationship with us, information about transactions, or notifying you of updates to our Privacy Notices or Terms of Service. The effect of an opt-out will be to stop personalized advertising, but it will still allow the collection of information for certain purposes such as usage, research, analytics and internal online services operation purposes). You may still see non-personalized advertisements, including ads based on general geographic region. In addition to that, we do not allow third parties to track or collect your personal information on our sites for their own advertising purposes without your explicit consent.

Please note that we also carry out digital advertising campaigns from time to time that do not rely on your personal data.

5. Storage of your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

Please note that we often need to retain certain data for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion. In addition, there may be certain data that we may not allow you to review for legal, security or other reasons.

Your personal data may be stored on computer systems in a country other than the country in which your information was collected. In our best efforts to protect your personal data, storage locations will be selected in countries that have similar privacy laws.  Any such storage will also be subject to audit and tracking requirements set forth in this Privacy Policy.

6. Cookies

When you use our Services, we and our service providers may place cookies (data files on your phone or mobile device’s drive) or similar technologies. We use cookies to help us identify you as a user, to provide you a better experience on our Website, to measure promotional effectiveness and to ensure trust and safety on our Website. 7.  Accessing, Reviewing and Changing Your Personal Information 

We cannot modify your personal information or account information. You can modify your own information by logging into your AllGood account. If you want to close your account (where applicable) with us, access your personal information or wish to express any concerns regarding how we handle your personal information, please send us a request to us. You can contact by writing to support@allgood.market to access your personal information stored by us that is not directly accessible on All Good, unless we are not required to provide access under applicable law. If your information is factually incorrect or incomplete or irrelevant for the purposes for which we process your information, you can request us to modify or delete your information (see more in Part 9 of this Policy under “Your Rights”). 8. Protection, retention and accuracy of your personal information

We protect your information by using technical and administrative security measures (such as firewalls, data encryption, and physical and administrative access controls to the data and servers) that limit the risk of loss, abuse, unauthorised access, disclosure, and alteration. Nevertheless, if you believe your account has been abused, please contact us as indicated in Part 7 of this policy (“Accessing, Reviewing and Changing Your Personal Information “).  

To keep your personal information secure, you are required to safeguard any user name or password information in accordance with the Terms of Service.

We do our best to ensure information we collect is accurate, complete and up-to-date. We rely on our users to disclose to us all relevant information and to inform us of any changes.

We retain personal information no longer than is legally permissible and delete personal information when it is no longer necessary for the purposes as described above.  Data that is not personal in nature may be kept by us for an indefinite period however, this does not constitute a guarantee that we will keep the data indefinitely.  Data referred to in the preceding sentence will primarily be used in aggregate and anonymized format to drive business intelligence, analytics, development of the Services, or any other use described in this Privacy Policy.

AllGood's employees and contractors are required to adhere to standards and policies to ensure that personal information is secure and treated with the utmost care and respect. Furthermore, AllGood limits access to your personal information to those employees or contractors who AllGood reasonably believes need to come into contact with that information in order to do their jobs, and personal information will only be reviewed if anonymize of otherwise accessed on a “need-to-know” basis.

All employees must read, and attest to having read this Privacy Policy. Furthermore, as this Privacy Policy is evergreen, any time material changes are made to the document, employees will need to attest to having read and understand the changes to the document. From time to time, training shall be provided to employees on this Policy Privacy and privacy issues required to be compliant with the applicable law.

9. Your rights

If you wish to exercise any of the rights set out below, please contact us as provided in Part 7 of this policy (“Accessing, Reviewing and Changing Your Personal Information”). 

Right to request access to your personal data. This enables you to receive a copy of the personal data we hold about you.

Right to request correction of any of the data we have about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Right to request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where you believe our use of the data is unlawful; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Right to request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Please note that for certain purposes we may be legally obligated to retain your data.

Right to object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which you believe impacts your fundamental rights and freedoms. You may also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may deny your request if we have compelling legitimate grounds to process your information.

Right to request for the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a commonly used format.

Right to withdraw your consent to the processing of your personal data at any time. This does not affect the legality of any processing we have already carried out based on the consent given previously.

Once you make a request regarding your personal information, we will respond with details of whether we hold personal information about you, what that information is and how it has been use as well as what third parties we shared it with. We encourage you to advise us whether the information we have is inaccurate or incomplete and we will correct or update it if appropriate.

No fee usually required: You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Time to respond: We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.

However, before you make a complaint to the data protection authority, we would appreciate the chance to deal with your concerns in the first instance, please reach out to us.

There may be instances where we cannot grant you access to the personal data we hold about you. If that happens, we will give you written reasons for any refusal. Where permitted by law, we may also disagree with your request to correct or update your personal data (for example, if we consider that your proposed update is incorrect).

In addition to the foregoing, you may have additional rights depending on your local law.

We reserve the right to verify your identity in connection with any requests regarding personal data to help ensure that we provide the information we maintain to the individual to whom it pertains and allow only that individual or their authorized representatives to exercise rights with respect to that information. We will try to comply with your request as soon as reasonably practicable. Please note that your exercise of these rights is subject to certain exemptions and our interests.

 

10. Other information

Abuse and unsolicited commercial communications ("spam"): We do not tolerate abuse of our Website. You do not have permission to add other AllGood users to your mailing list (e-mail or postal) for commercial purposes, even if a user has purchased something from you, unless the user has given his explicit consent. If you notice that someone is abusing our Website (spam or spoof emails), please notify us by writing to support@allgood.market.

It is not allowed to use our member-to-member communication resources to send spam or content that violates our Terms of Service in any other way. For your security, we may scan messages automatically and check for spam, viruses, phishing and other malicious activity or illegal or prohibited content. We do not permanently store messages sent through these resources.

Third Parties: Unless explicitly provided otherwise in this Privacy Policy, this Privacy Policy applies only to the use and transfer of information we collect from you. AllGood has no control over the privacy policies of third parties that may apply to you. When we work with third parties or use third party tools to provide certain services, we will explicitly indicate which privacy policy applies to you. We therefore encourage you to ask questions before you disclose your personal information to others.

Our Website may contain links to third party websites or apps. If you click on one of these links, please note that each one will have its own privacy policy. We do not control these websites/apps and are not responsible for those policies. When you leave our Website, we encourage you to read the privacy policy of every website you visit.

Children: Our Services are not designed for use by individuals under the age of 13. If you are under the age of 13, please do not use the Services and/or submit any information through the Services. If you have reason to believe that a child under the age of 13 has provided personal information to AllGood through the Services, please contact us at support@allgood.market and we will delete that information from our databases to the extent required by law.

User submitted content: Some features of the Services allow you to post content on our Website or social media pages, such as photos. We do not have control over how other users who have access to the Website will use any content you post publicly or send to them privately. We urge you to exercise discretion when sharing personal information with other users.

We may also use any ad you post on AllGood, including the uploaded photo or image of the product as well as other data (including user name and location) associated with the ad, for our own advertising purposes, including social media, Facebook ads, newsletters and ads for any media.  By posting content on the Website,  you hereby grant to AllGood a worldwide, non-revocable, non-exclusive, perpetual, royalty-free, and sub-licensable right to use, create derivative works of, modify, and distribute (including without limitation, distribution online, through multiple channels, and bundled with other applications or materials) such content, and further, agrees to waive any moral rights to such content, and agree that AllGood may modify or adapt such content in order to transmit, display or distribute it over other applications and in various media. You agree that you will individually and jointly defend, indemnify and hold harmless AllGood from and against any claims arising from the nature of the content submitted and/or the ownership of content posted by you and any claims of infringement of third party intellectual property related to such content.

To help protect your privacy, we allow only limited access to other users’ contact information as necessary to fulfil your transactions, collect payments and process donations. However, when users are involved in a transaction, they may have access to each other’s name, user ID, email address, and other contact information.
